Data purpose

What we collect,
and why we need it

A number of personal details are collected by European Whisky Auctions. All data will only be processed with your explicit consent or for the execution of the agreements that are entered into, or because processing is necessary to bring you into contact with potential relations and/or (sub)contractors.

In everyday terms: we ask for what is needed to answer you, to let you bid, and to pay you when your bottle sells. Nothing is collected because it might come in handy later.

Contacting us Name, e-mail, phone, question

Your data will be collected when you contact European Whisky Auctions through the website. However, this form only asks for the information necessary to provide you with an answer, such as your name, e-mail address, telephone number and question or comment.

The telephone number is optional. A copy of the message goes to your own inbox as well, so you keep a record of what you sent without having to rely on ours.

Platform account If you buy or sell

Your personal data is collected when you create a Platform account for the purpose of selling or buying whisky. The following information is collected: name and address details, e-mail address, age, bank account and name.

If you create a business account, you will also be asked for your VAT number and a Chamber of Commerce number. Our payment partner may also ask for proof of identification.

Analytics Anonymous, and not linked to you

The European Whisky Auctions website collects your data in order to improve the website. This is done with Google Analytics. This information is anonymous and is therefore not linked to your personal data. This includes information such as the duration of your visit to the website or the pages that you visit regularly.

It is what tells us that a particular information page is being opened and abandoned, which is usually a sign that the page is badly written rather than that the subject is dull.

Receivers

The data we receive is managed
by means of three parties

A payment provider, a mailing service and the company whose servers the Platform runs on. That is the complete list — there is no advertising network, no data broker and no analytics suite beyond the one named above.

Payments

Stripe

Stripe is our payment partner and processes payments through the Platform. Stripe receives name and address details, bank account and age. In the case of business sellers, Stripe also receives the VAT number and Chamber of Commerce number.

Stripe may request proof of identification, which must be uploaded to Stripe's servers. European Whisky Auctions does not receive these documents. Also, European Whisky Auctions does not receive any credit card information, as these are verified directly on Stripe's servers.

Newsletters

MailerLite

We use MailerLite to send newsletters and auction-related announcements. You can unsubscribe from our mailings at any time.

Every mailing carries an unsubscribe link at the foot of it, and it works immediately rather than after a fortnight of "please allow up to".

Hosting

DigitalOcean

The auction platform of European Whisky Auctions is hosted on cloud servers of DigitalOcean. All data you make available is stored on these servers.

The photographs of the lots and the files you upload to your account are stored there as well.

Storage period and security

Where it sits,
and who can reach it

Four measures, none of them exotic. The point of listing them is not that they are clever but that they are the whole of it — there is no other system holding your data and no other route into the ones that do.

Storage period As long as needed, no longer

Your data will be kept by European Whisky Auctions for a longer period of time, but never longer than is necessary for the performance of activities, unless we are required by law to keep your data for a longer period of time.

The obligation that bites in practice is the Dutch fiscal retention period: anything that touches an invoice has to be kept for seven years, whatever anybody would prefer.

No paper copies Nothing in a filing cabinet

No physical copies of your personal data will be made. Your data will only be managed in the aforementioned systems and software.

It is a short clause with a real consequence: there is no drawer of printed customer records anywhere in the building.

Access Passwords, two factors, few devices

The personal data managed by European Whisky Auctions or by the aforementioned third parties are only accessible via the above mentioned software and are protected by a password and, where possible, by a two-step verification. In this two-stage verification, a code is generated from the software and sent to European Whisky Auctions. This code must be used during the login process.

The devices that open your data are each also locked with a password and/or fingerprint. The number of devices that have access to your data is limited to only the required devices.

In transit Encrypted end to end

Your visit to our website is secured by an SSL certificate. This means that your connection to the European Whisky Auctions website is private: what you send us — a bid, a password, an address — cannot be read by anybody in between.

Every page of the Platform is served this way, not only the ones with a form on them.

Your rights

These are not favours we grant — they are rights you hold under European data protection law, and exercising one is a matter of writing to us. There is no form to fill in and no reason to give.

An e-mail to info@europeanwhiskyauctions.com starts any of them. We will confirm what we have done, and we will not ask you to reconsider.

Right of access

You have the right at all times to request your data, which is recorded and stored at European Whisky Auctions. You can do this by sending an e-mail or contacting us by telephone. You will then receive an overview of your data.

Right to rectification

Does your data not add up? Or has your data changed? You have the right to have this rectified by European Whisky Auctions. You can change your information about the newsletter via the URL at the bottom of each e-mail.

Right to erase data

Do you no longer want your data to be stored at European Whisky Auctions? Then you have the right to have your data deleted. This may result in us no longer being able to be of service to you.

Right of transfer

If you need the data stored at European Whisky Auctions in the event that you switch to another party or service, you are entitled to a transfer. European Whisky Auctions is required to transfer all your data to the other party. It is possible that a fee will be charged for this.

Right to complain

You have the right to submit a complaint to the Dutch Data Protection Authority if you believe that European Whisky Auctions does not handle your data correctly.

Right to stop data use (objection)

Do you not want European Whisky Auctions to use your data? Then you have the right to stop the use of your personal data. This may result in us no longer being able to be of service to you.

Rights on one side, obligations on the other. This is the ground we process your data on, the minimum we will ask you for, and the only circumstances in which anything is passed on.

The sentence that matters most is the shortest one: your data will never be sold to third parties.

Processing data On a legitimate interest

European Whisky Auctions processes personal data on the basis of a legitimate interest, namely a commercial interest. This includes offering services or products from European Whisky Auctions via e-mail. Your data will never be sold to third parties.

The information that is required to deliver is the minimum information required to offer services or products.

Data retention What we cannot do without

For example, your e-mail address is required to send an e-mail. If this required information is not provided, European Whisky Auctions will not be able to offer the service in question.

The same holds for an address on a shipment and a bank account on a payout: without them the thing you asked for simply cannot happen.

Sharing of data Your permission first

If it is necessary to share data that you have shared with European Whisky Auctions with others than the above parties (e.g. for the provision of a service), your permission will be requested first.

The everyday example is a carrier: a shipment cannot be delivered without your name and address reaching the courier.

Right to reveal When the law requires it

European Whisky Auctions reserves the right to disclose the data when required by law or when European Whisky Auctions deems it justified to comply with a legal request/proceedings or to protect the rights, property or safety of European Whisky Auctions. In doing so, we always try to respect your privacy as much as possible.

For sellers there is one disclosure that is not discretionary at all: European reporting rules for online platforms oblige us to report certain seller details to the tax authorities.
